Judge Blocks Ugandan Slay Queen Charlotte Komugisha’s Bid to Have Their 12-year-old son Testify Against Her Estanged Boyfriend in Their Divorce Case

Renowned Kampala tik toker Komugisha Charlotte Muhwezi, who has been fighting with her boyfriend over existence of marriage and property in one of Kampala’s upscale neighborhoods of Makindye, was on Wednesday dealt a huge blow in Court when the presiding magistrate Magara refused her request to have one of their three children, aged 12 years and is in P7, to come to Court and give evidence against his father.

The boyfriend wants Court to help him overcome Charlotte, the 48-year-old slay queen, who has refused to leave his home in Makindye long after he clearly lost interest in her.

She claims to be his wife, which the boyfriend is contesting in Court saying that she is just a cohabitee, who he is no longer interested in. They have three children aged between 7 and 18 years but they have never been wedded in church to become husband and wife.

Saying it’s unsafe to continue staying which such an abusive woman, who has gone as far as threatening physical violence, the boyfriend wants to use Court to get her out of his way.

Not only is he scared of her because of her abusive disposition, the Court documents filed in the Makindye Court also show that his heart is no longer interested in her. He wants her to leave so that they each lead their life seperately.

So, on Wednesday the magistrate heard the boyfriend’s application to have their 12-year-old son put in bording school in order to shield him from seeing daily quarreling between his two parents who are quarreling every day and night at their Makindye mansion. He wants his son out of the chaos as the main application he filed for divorce gets concluded.

The boyfriend believes that the quarrelsome environment at home has become so toxic, its beginning to emotionally affect the child’s education and emotional welfare contrary to the provisions of the constitution and the Children’s Act.

The boy has been at Makindye Junior Primary School, a Kampala surburb near home and now the father wants him to be relocated to Victoria Mutundwe primary school, which is a sister school, for bording section.

Ugandan journalists who were at Court and followed the controversial case on Wednesday say that the boyfriend even showed the magistrate receipts showing that the boy’s school fees of 2m for bording had already been paid at Victoria Mutundwe primary school.

Charlotte is opposed to the boy going to bording because, as her lawyers told the magistrate on Wednesday, she fears that this will cause the boyfriend to stop buying food and other requirements to mantain her in the Makindye home.

The boyfriend says that he is no longer interested in her and wants her to leave the home and let him be. He says she has been unleashing a lot of emotional violence on social media including inciting the couple’s children to abuse and disrespect him on family WhatsApp groups.

The boyfriend’s lawyer Rob Ebubura, a Kenyan, told Court on Wednesday that the environment at the Makindye home has become so toxic to the extent that there are fears that one of the two (Charlotte and the boyfriend) might harm and kill the other if Court doesn’t help to force physical seperation between them, something Charlotte is curiously opposing even after concluding that the father of her three children is a very bad person.

Since the two have failed to agree on whether to put their 12-year-old son in bording school or not, the boyfriend applied seeking a Court order directing the relocation of his son from day to bording school.

Charlotte, who has no income because she is jobless and also unemployable, is opppsed to this saying the boyfriend wants to use that puting away of their son as an excuse to stop materially providing for her and buying food in the home, something that obviously will expose her to destitution and starvation.

During the Wednesday Court session, Charlotte tried to deny that 2m fees had already been paid for the boy’s school fees and added that the receipt wasn’t gumite. But the judge disregarded her claim after failing to provide any evidence. The magistrate will be giving his ruling on whether the boy goes to bording or not on Friday.

Her request to have the boy personally come to Court to pin his own dad and also to tell Court whether he prefers bording or day school was rejected by the magistrate who said it was clear the boy’s mind had already been manipulated and biased by his mother who it was showed to Court has been inciting the three children to hate their dad as a monstrous person. In her affidavit evidence, Charlotte had already indicated how the children too are against their daddy.

The magistrate ruled on that application and made clear that there is no way the boy would tell Court he prefers bording school as is being advocated by his father because of indoctrination by the mother.

The boyfriend’s lawyers explained how and why it wouldn’t be in the best interest of the 12-year-old for him to continue remaining in a home where things had become so bad to the extent that the two parents don’t talk to each other anymore (except when they are quarreling/barking at each other) and seperated bedrooms long time ago.

The lawyers also explained to Court that Victoria Mutundwe primary school and Makindye Junior are equally good schools since they are under the same management and ownership.

They also succesfully rebutted tik toker Charlotte’s claim that the child had been medically examined in Nsambya hospital and found to be medically unwell and therefore unsuitable for bording section. They also dispelled claims that the receipt indicating 2m had been paid for the boy’s fees in the bording section had been forged.

Journalists and Charlotte’s friends who were at the Kampala Court on Wednesday say that the couple will be returning to Court on Friday to receive the magistrate’s ruling on whether the boy goes to bording school or not.

He has to sit for PLE this very year, which further increases pressure on the magistrate to urgently decide the daddy’s application on whether to have him stay at Makindye Junior or relocate to Victoria Mutundwe.

This application is besides the main application in which the boyfriend is seeking help of Court to declare that Charlotte has never been his wife and subsequently force her to leave his Makindye an get somewhere else to go and begin living.

Concerned friends are wondering why Charlotte doesn’t want to let the boyfriend go yet her social media in-laws are repeatedly unleashed to portray him as a very bad person.

Many observers following the case at the Kampala Court are wondering why Charlotte, who has also previously been accused of being involved in other relationships, wants endless chaos instead of letting the man go and rebuild his life after being in such a ruinous cohabitation relationship for all these years.

The magistrate’s refusal to grant the application to have the 12-year-old boy come to Court to testify against his daddy, made Charlotte to become very demoralized, according to one of close friends who offered to update us on this story on strict condition of anonymity.

Objective observers at the court praised the magistrate for acting so prudently by opting to leave such a young boy of court proceedings involving his mum on one hand and his dad on the other. It would make worse an already bad situation even worse besides traumatizing him for the rest of his life.
